HOMEOWNERS ASSOCIATION
RESOLUTION 2001-1
MEMBERSHIP APPROVAL OF DEDICATION OF COMMON
AREA
AND ANNEXATION OF ADJACENT LOTS INTO ASSOCIATION
WHEREAS, the Articles of Incorporation and
the Declaration of Covenants, Conditions and Restrictions of the FAIR Oaks
Estates Homeowners Association provide that the Association, by a vote
of the membership, may dedicate property to the County and agree to annex
additional land into the Association; and
WHEREAS, the owner of five lots ("lots") adjacent
to the community (as more specifically shown on the attached plat marked
as Exhibit A) has approached the Association about the development of lots;
and
WHEREAS, as a condition for developing the
lots, the County is requiring that one of the lots have access to Ox Hill
Road if and when the lot is developed and that such access would be over
common area of the Association in the area noted on Exhibit A; and
WHEREAS, in return for the dedication of the
access road, the developer of the lots has agreed to bind the lots to the
covenants of the Association if such annexation is approved by the membership;
and
WHEREAS, the Board of Directors believes the
annexation of the lots into the Association is in the best interests of
the Association as such annexation would obligate the owners of such lots
to contribute to the assessment pool of the Association and would subject
the lots to the architectural maintenance and repair restrictions of the
Association.
NOW THEREFORE, the members of the Association
do hereby approve of the following:
1) The Board of Directors will be entitled to dedicate
to Fairfax County a portion of the Association common area as an access
road as set forth on Exhibit A;
2) The Board of Directors is entitled annex the lots
contained on Exhibit A into the Fair Oaks Estates Homeowners Association
and is empowered to execute appropriate documentation to complete the annexation
of the lots.
ADOPTED this 24th day of July, 2001 at a meeting
of the membership by at least two-thirds of those voting in person of by
proxy.
